A Durable Power of Attorney gives authority to another person (called the “Agent” or the “Attorney-in-Fact”) to make decisions concerning your money, property and health care. Although a useful estate planning document, great care must be exercised in selecting your Agent since the Agent will have broad and sweeping powers to sell or otherwise dispose of your property, and to spend your money without advance notice to you or approval by you. The Durable Power of Attorney should not be considered as a substitute for a Living Trust. The Durable Power of Attorney cannot be used after death. If desired, the Durable Power of Attorney may be limited to health care issues only or limited to legal and financial issues only. If desired, more than one Agent may be named on the Durable Power of Attorney.
